Condominium Law
Condominium law deals with the preparation of amendments, by-laws, and declarations, filing of condominium liens, collection of delinquent assessments, developer turnover, eviction and foreclosure matters, insurance coverage disputes, and enforcement of homeowner association by-laws.
Most condominium law cases involve a dispute between an individual unit owner and the homeowner’s association. An example of this is when an individual unit owner fails to pay their monthly assessments for a period of months. Often times at this point, a condominium law attorney will be hired by the homeowner’s association to assist in collecting past due amounts and creating a payment plan with the delinquent unit owner to ensure prompt payment in the future. We also see many cases where a condo owner wants to bring an action against the association for failing to meet its obligations.
Condominium law is governed by the Illinois Condominium Property Act.
